This
is very terrible, if someone had buy the plots, but finally facing
problem in possession or when that person try to sell someone, but
unable to sell the property. We use a word Land Mafia who is only
responsible for your trouble.
Everyone
knows that how difficult to buy a plot and make a home. I mean, they
are investing gross earnings of their whole life. Hence someone faces
this type of complication, i think that is terrible.
1-In
this situation, you should collect and check the all related
agreement documents firstly from government office and try to know,
you
have not been cheated by the seller, if all documents are in your
favor then the laws will help you for your possession. I think
that’s a good news for you.
2-Now
the time has come for you to complain a FIR in your Polish station in
written form by mentioning all characters and proving documents. If
police doesn’t accepting FIR, provision exists to file private
complaint in criminal court directly. Under the Indian Penal Code
1860, Chapter XVII,
Section 441, Whoever enters into or upon property in the possession
of another with intent to commit an offence or to intimidate, insult
or annoy any person in possession of such property, or having
lawfully entered into or upon such property, unlawfully remains there
with intent thereby to intimidate, insult or annoy any such person,
or with intent to commit an offence, is said to commit criminal
trespass. You are legally in possession even though you may not
physically occupy the plot. Land Mafia’s have political
connectivity, if you know who is backing him/her, then try to ask
with the opposition. But it has no any surety that your problem will
being solve. You should forward your petition to SP and AIG office of
your area mentioning the plight rendered to you by local police and
land mafia Mostly it is heard that the Polish is doing nothing and it
has a collusion with the Land mafia.
3-When
problem remains unsolved, get ready to hire, a legal person or good
lawyer, and explain the all things. Right now you have only a legal
option. You may write a letter to your CM and PM attaching all
documents, but it not always works. So keep in mind that you can get
justice from Indian court only. Sometime it seems very expensive and
time taking, but keep your faith in Indian court they are the only
will be able to make your possession.
In
Mohali, there are many Real Estate companies which are offering
different verity of commercial and residentialplots near PGI Chandigarh with
different criteria. So check the best suite to you, either for
residential or commercial purpose. At the time of agreement you
should check all the detail very carefully to avoid future possession
problem. And also register your plot in the Municipal Corporation.
